Lessons from M&S’s unfair dismissal of autistic worker accused of harassment

A UK tribunal has ruled that Marks & Spencer discriminated against and unfairly dismissed an autistic worker because it did not properly consider his condition when investigating a colleague’s accusation of sexual harassment.

Jack Clarke was employed by the British retailer between 2015 and 2022 at stores in Oxford, Cowley, Summertown, and Didcot, where he fulfilled several roles from shop assistant to assistant baker. He had been hired as part of a programme helping disabled people into work.
