In South Africa, where unemployment stands at 32%, the majority of mergers are approved on the condition there be no retrenchments. But in a recent landmark ruling, the nation’s Constitutional Court granted Coca-Cola Beverages Africa (CCBA) the right to dismiss 400 workers during the usually prohibited post-merger period due financial losses.
