Lessons from Shopee’s failed non-compete claim in Singapore

An attempt by Shopee to prevent a former senior employee from joining rival TikTok was rejected by a Singapore court last week after a judge found the e-commerce platform’s non-compete clause to be unenforceable.

Finding against the geographical scope of the tech firm’s restrictive covenant, the judge said he had serious doubts that Shopee’s clause would be “regarded as reasonable as between the parties or reasonable in the interest of the public”
